These general terms and conditions (hereinafter “Terms and Conditions”) apply to everything between a customer (hereinafter “you” or “customer”) and us, stylaz. creative studio, Bernhard - Nocht - Str. 101, 20359 Hamburg (hereinafter “stylaz. creative studio”, “us” or “we”) through our shop at www.stylaz.de (hereinafter “shop”) and for all contracts concluded Design orders and contracts from the creative brand studio (hereinafter “studio”, “creative brand studio” or “stylaz. creative studio”). Conflicting or deviating terms and conditions of the customer do not apply; all of the customer's terms and conditions are hereby contradicted.

Our offers and services are primarily aimed at consumers within Germany. For the purposes of these General Terms and Conditions, a customer is any natural person who enters into the contract for a purpose that can be attributed to their commercial or independent professional activity as well as their private life.

We do not offer any products or services for purchase by minors.


 

SHOP

Our print products are offered via the platform www.etsy.com/de/. This means that all valid terms and conditions of this provider apply to the purchase of postcards and posters (can be read at www.etsy.com/de/legal/terms-of-use)


 

COPYRIGHT OWNERSHIP

We reserve all copyrights and other rights to our designs and products as well as the published content, information, images, videos, databases and downloadable files that are available for purchase in the shop (hereinafter “Protected Property”). Any modification, reproduction or publication of the protected property without our prior written consent is expressly prohibited. Stylaz also has . creative studio retains all copyrights in the works created under this agreement.


 

CONFIDENTIALITY

It is our policy to respect your privacy regarding any information collected. Before or at the time of collecting personal data, the purposes for which the data is being collected will be identified. We collect and use personal data solely to fulfill the purposes specified by us and for other compatible purposes, unless we obtain the consent of the data subject or there is a legal obligation.
 

PERMITTED USE OF PRODUCTS

You receive from stylaz. creative studio a non-exclusive license to the products made for you. This license permits you to make personal use of the Products, provided that you give appropriate credit to the designer upon each use. You may not copy, reproduce, distribute, republish or allow others to do so. Please also note that you are not allowed to alter the final graphic, such as cropping, distorting, manipulating or animating it. All copyrights, trademarks and other intellectual property rights continue to belong to stylaz. creative studio. The protected material is for your personal use only. Please note that passing on or publishing the designs or design drafts to third parties is strictly prohibited and constitutes a violation.


 

ARTISTIC RELEASE

You have spent sufficient time reviewing creative brand studio's work and have a reasonable expectation that we will provide our services in a similar manner and style, unless otherwise specified in this Agreement. You recognize the creative freedom and individuality of our designs. By this agreement you grant stylaz . creative studio an artistic release that allows us to bring our artistic vision and expertise to create unique and original works. The creative brand studio has the freedom to make its own decisions in terms of design aesthetics, color scheme, layout and style to achieve the best possible result. You forego it, stylaz . to restrict creative studio in its creative decisions or to subsequently change our works, provided that this does not affect essential contractual obligations.


 

CONSISTENCY

We at stylaz. creative studio will do our best to ensure that the services you require are produced in a style and manner consistent with our current portfolio. We will also take your suggestions into account appropriately. However, please understand that:
1) Every customer is unique and has different tastes, budgets and needs.
2) Design services are essentially a subjective art form and we have our own unique vision with an ever-evolving style and technique.
3) In providing the Services, we use our artistic judgment, which may not always include strict adherence to your suggestions.
4) Although we will do our best to consider your suggestions and requests, we reserve the final say on the aesthetic judgment and artistic quality of the services. Changes Unless otherwise stated, for any changes requested by the customer that are outside the scope of the service, the customer will pay additional fees for the labor of the corrections that were not included in the offer.

 

LIABILITY

Our liability is limited to culpable violation of contractual obligations or intentional/grossly negligent violation of other contractual obligations. Essential contractual obligations are indispensable obligations for the fulfillment of the contract that you regularly rely on. In the event of negligent violation, we are only liable for foreseeable damage. Furthermore, we assume no liability. You agree that the maximum possible damages you may recover for any claim related to this Agreement or the services provided shall not exceed the total cost of the services provided by "stylaz. creative studio".


 

SEVERABILITY CLAUSE

If any part of this Agreement is determined to be unlawful or unenforceable, the remaining provisions of this Agreement will remain in full force and effect.
